US Senate Shelves Crypto’s CLARITY Act Before August Recess

The crypto industry’s biggest legislative priority of the year just missed its window. Senate leadership has confirmed that the CLARITY Act, the market structure bill meant to give digital assets a clear regulatory framework, will not get a floor vote before Congress breaks for its August recess.
The bill has already cleared the House and the Senate Banking Committee, but a full Senate floor vote has repeatedly slipped as other priorities, including Russian sanctions legislation and federal nominations, absorbed the chamber’s limited floor time. Senate leadership says the bill simply did not fit into the calendar before the recess begins.
The delay is not just a scheduling problem. Democrats have conditioned their support on adding ethics provisions targeting conflicts of interest tied to the Trump family’s crypto ventures, which have reportedly generated over $2 billion. A revised Republican draft added some ethics language, but critics say it leaves significant loopholes, and neither side has fully signed off.
Prediction markets have priced in the growing uncertainty: odds of the bill passing this year have fallen to roughly 37%, down sharply from over 80% earlier in 2026. August 10, the start of the Senate’s state work period, is now being treated as an unofficial final deadline for action before lawmakers head home and the legislative calendar gets even tighter heading into the fall.
For an industry that has spent years asking for regulatory clarity, watching the bill named exactly that stall over political disputes unrelated to the substance of crypto regulation is its own kind of irony.
